The way I look at it, when a police officer is off-duty, he's a private citizen and no official privileges should apply. If he wants to carry a gun, he should be doing it as a private citizen, in accordance with all local regulations and applicable licensing. And he should be liable for his actions as any other private citizen.

Furthermore, if he's still a "police officer" 24/7 as so many departments seem to insist they are... then he should be paid for 40 hours per week and another 128 hours at the overtime rate, for a full 168-hour work week. You work, you get paid. It's Federal law, and in every state I'm familiar with.

If he's not being paid, then he shouldn't have the privileges of the badge. Q.E.D.
